Terms

 

REGISTRATION INFORMATION:

1.    This is an online ONLY auction and NO shipping will be available, pick up ONLY. 

2.    You are required to create an online account with a VALID e-mail in order to register and bid.  It is your responsibility keep your profile information up to date and valid as we rely on that information to process payment and contact you when necessary.

3.    VALID credit card is required at registration for bidding approval. There will be a pre-auction authorization charge in the amount of $1 to establish credit. 

4.    By registering, you are acknowledging that you have read and agree to all terms and conditions of the auction. 

5.    We reserve the right to refuse service to anyone.

 

AUCTION NOTICE:

1.    A 10% Buyers Premium will be added to all personal property purchases. No sales tax will be collected unless it is a consignment or business liquidation.

2.    All items are sold on an AS IS, WHERE IS basis with NO WARRANTY. 

3.    Inspection of item(s) is the buyer’s responsibility.

4.    ALL sales are FINAL so please place bids accordingly as NO refunds will be issued for any reason.

5.    Property is open to public inspection during the preview time specified.

6.    The auction company is NOT responsible for accidents, thefts or errors or omissions.

7.    Neither the Auctioneer nor our client make any guarantees and are not responsible for listing or advertising inaccuracies or discrepancies.

 

BIDDING NOTICE:

1.    Once bidding is closed, the items you won are YOUR responsibility. 

2.    Items will end in numerical order every 30 seconds. If a bid is placed in the final minute, the bidding will be extended by 2 minutes.  The time extension for one lot will not have an effect on any other lot and lots will continue to close as scheduled unless there is active bidding on them.

3.    You will receive outbid notices via the method you selected during registration.

4.    It is the bidder’s responsibility to confirm all bids before they are placed.  If a bid is placed by mistake or you no longer want an item, NO bid will be removed or lowered.

5.    Marquette Auction Services is not responsible for any internet malfunctions, loss of connection or system glitches that may prevent a last minute bid to be placed. 

For Firearms: purchaser will be required to complete a waiver form and will have their picture taken with valid ID before gun is released to purchaser. All FFL laws apply, such as, you must be at least 18 years of age or older (21 years of age for hand guns), not an illegal alien, have not renounced US citizenship, are not an addict, have not been diagnosed as mentally ill, are not a convicted felon, not under indictment, not a fugitive, have not been dishonorably discharged from the military. Marquette Auction Services only accepts firearm purchases by Missouri residents. No transfers will be permitted to other states.

PAYMENT:

1.    VALID credit card is required at registration for bidding approval.  There will be a pre-auction authorization charge in the amount of $1 to establish credit. 

2.    An invoice will be e-mailed to you once the auction has closed, please check junk/spam folder if necessary. 

3.    Payment is due BEFORE items can be removed from premise. 

4.  Payments can be made via credit or debit card online with a 3% convenience fee or with cash on pick up day. If invoice exceeds $1,500, cash will be the only form of payment acceptable unless otherwise previously arranged for wire transfer or cashier’s check from local bank & funds will be verified prior to items being released to purchaser.  

5.    Payment is due by pick up date specified.

6.    Violators will be prosecuted and banned from future auctions.

 

PICKUP & LOAD OUT

1.    You MUST present a paid receipt at time of pick up for items to be released. 

2.    ALL items must be picked up within the pick up time frame specified as this is the ONLY time that items will be accessible. 

3.    Winning bidders are responsible for ALL dismantling/moving of items. 

4.    Buyers need to bring their own packing material (boxes, totes, bubble wrap, newspapers, etc.) as these items will NOT be available on site. 

5.    Marquette Auction Services is NOT responsible for assisting with the removal of items so plan accordingly if you are unable to remove items yourself.

6.    If you are unable to pick up or are a no show at pick up, the credit card on file WILL be charged for the balance due and the items purchased will be forfeited.

7.    If ANY damage occurs to individual items or to the pickup location during removal of items, the buyer assumes full responsibility for the damages incurred.

A   Any Titles will be distributed on the auction Pickup day ONLY if payment is made in cash. Otherwise, titles will be processed and mailed 14 days after the auction Pickup, contingent upon confirmed payment.

REAL ESTATE TERMS

  7. Bid acceptance will be conducted on a confirmation of seller approval basis. Auction may pause for auctioneer to confer with seller for approval.
  8. Winning bidder MUST execute and return contract with earnest money deposit by end of business day of auction or will be considered in default.  Failure to submit contract and earnest money will result in a penalty fee of $1,000.00 to be charged to the credit card that was provided at registration.  Marquette Auction Services reserves the right to sell to the back up bidder in the event the highest bidder does not comply with sale terms.
  9. There will be a 4% buyer’s premium on Real Estate with a $20,000 non-refundable earnest down payment due on day of auction in the form of personal check, business check or cashier’s check upon signing a purchase by end of business day on day of auction closing. Since earnest money is non-refundable, MAKE SURE YOUR FINANCING IS IN ORDER. Any boundary lines drawn on pictures or maps are approximate and not binding. Bidding is not contingent upon financing, inspection, or appraisal. Closing will be within 30 days of the sale date at True Line Title Company in Mexico, MO.
  10. Seller shall convey a Warranty Deed to the buyer for examination and pay for title insurance.
  11. The real estate taxes shall be prorated between the parties as of the date of title closing.
  12. Possession of the real estate shall be delivered to the buyer at the time of title closing.
